IEBC clears Waititu in heated Nairobi race


Ferdinand Ndung’u Waititu Baba Yao may be in the ballot as Kenya’s electoral body cleared him for the polls, potentially slated for February 16, 2021.

Waititu had earlier been barred from contesting the seat on the strength of his impeachment as Kiambu Governor and his criminal case currently pending in court. IEBC Chairperson Wafula Chebukati had indicated that everyone thrown out of office via impeachment did not stand eligible for election in any public office.

Waititu however challenged IEBC’s position in court indicating that he was yet to get convicted on the crimes placed against him.

IEBC has formally gazetted his name alongside 12 other individuals contesting the seat as independent candidates. The EACC had waded into the matter indicating that impeached state officials held no capacity, or right, to re-enter public office through elections.

The Nairobi gubernatorial seat became vacant upon the conclusion of Mike Mbuvi Sonko’s impeachment process. Sonko has already moved to court to halt the by-election until his petition nullifying the impeachment is heard and determined.
